O escalonamento da implementação do Relógio de Ponto

A obrigatoriedade do uso do Registrador Eletrônico de Ponto, de acordo com a Portaria 1510/09 do MTE será escalonada de acordo com o segmento econômico da empresa:

2 de Abril de 2012 – Indústria, serviço e comércio em geral
1 de Junho de 2012 – Empresas agro-econômica nos termos da Lei 5889 de 8 de Julho de 1973
3 de Setembro de 2012 – Micro e pequena empresa de acordo com lei complementar 123/2006 (a portaria oficial se refere a lei complementar 126/2006, que não existe, espero que venha alguma correção).

Abaixo o descritivo completo da Portaria que define o escalonamento

PORTARIA Nº 2.686, DE 27 DE DEZEMBRO DE 2011
O MINISTRO DE ESTADO DO TRABALHO E EMPREGO INTERINO, no uso das atribuições que lhe conferem o inciso II do parágrafo único do art. 87 da Constituição Federal e os arts. 74, § 2º, e 913 da Consolidação das Leis do Trabalho, aprovada pelo
Decreto-Lei nº 5.452, de 1º de maio de 1943, considerando o disposto na Portaria n.º 1979, de 30 de setembro de 2011 e as dificuldades operacionais ainda não superadas em alguns segmentos da economia para implantação do Sistema de Registro Eletrônico de Ponto – SREP, resolve:
Art. 1º – O art. 31 da Portaria nº 1.510, de 21 de agosto de 2009, somente produzirá efeitos:
I – A partir de 2 de abril de 2012, para as empresas que exploram atividades na indústria, no comércio em geral, no setor de serviços, incluindo, entre outros, os setores financeiro, de transportes, de construção, de comunicações, de energia, de saúde e de educação;
II – A partir de 1º de junho de 2012, para as empresas que exploram atividade agro-econômica nos termos da Lei n.º 5.889, de 8 de julho de 1973;
III – A partir de 3 de setembro de 2012, para as microempresas e empresas de pequeno porte, definidas na forma da Lei Complementar nº 126/2006.
Art. 2º – Esta portaria entra em vigor na data de sua publicação.
